ACGR Season Membership - TERMS & CONDITIONS
These Terms, together with the applicable order details presented at checkout, constitute the terms governing the Season Membership held by Season Ticket
Holders (sometimes referred herein as “STH”).
TICKET TRANSFER POLICY:
ACGR (“ACGR”) encourages STH to transfer individual game tickets through authorized methods if they are unable to attend an event. Any transfer or resale of
tickets remains subject to these Terms, applicable law, and ACGR and league ticket policies. However, Season Memberships are intended primarily for personal use
and not for commercial resale. ACGR reserves the right to monitor ticket transfers and use, and, in its sole discretion, may suspend or revoke membership benefits,
cancel ticket orders, or deny future renewal opportunities for accounts that ACGR determines are being used primarily for commercial resale or other unauthorized
ticket brokerage activity. In making this determination, the ACGR may consider the frequency and volume of ticket transfers or resales, resale patters, and other
relevant account activity. Any transfer or resale of tickets remains subject to these Terms, applicable law, and ACGR and league ticket policies.
REFUNDS & EXCHANGES:
Before purchasing tickets, carefully review the event date and seat selection. All ticket sales are final. No exchanges or refunds will be given after ticket(s) have been
purchased. Including tickets lost, stolen, damaged, destroyed or forgotten. Questions about purchase can be addressed by emailing: tickets@acgrandrapids.com.
SCHEDULE CHANGES
Game dates, times, opponents, and venues are subject to change. Except as otherwise expressly provided in these Terms, such changes do not entitle the STH to
a refund or credit.
DELAYS, CANCELLATIONS, OR RESCHEDULED EVENTS:
Delays or Inclement Weather That Does Not Result in Rescheduling. A delayed game means that the game is stopped but may continue when there is a change in
the conditions that caused the delay. In many instances, inclement weather does not result in postponement of a game. However, games may be delayed during
harsh weather or called off after they are declared official. When these situations occur, there are no refunds or exchanges available, even if fans decide to leave
the game due to uncomfortable conditions.
Rescheduled Game Tickets. A rescheduled game refers to a game that is stopped before it becomes official and is rescheduled for another time in whole or part.
If the replacement game is rescheduled to a new date, not in connection with another already scheduled game, then the tickets will be valid for the same seats for
the new game. There are no refunds for games rescheduled to a new date not in connection with another already scheduled game.
Cancelled Game Tickets. A cancelled game is one that is cancelled and not rescheduled. If a regular season game associated with a ticket purchased is cancelled,
not played or not completed for any reason, the agreed sale price, minus the processing fee, will be carried over for the original buyer to use for future purchases.
PLEASE NOTE: In no event will ACGR refund or issue credit for any amount of a ticket or any associated fees, including handling and processing fees, for a delayed
or rescheduled game or event.
REVOCATION OF PRIVILEDGES
ACGR reserves the right to, in its sole discretion, suspend or revoke tickets without refund, for nonpayment, fraud, unlawful conduct, violation of applicable fan
conduct policies, prohibited ticket resale activity, violation of the MLS Next Pro fan code of conduct policy (MLS Next Pro Fan Conduct Policy) or other material
violation of these Terms & Conditions.
TERM AGREEMENTS
Term. Subject to the conditions of this Agreement, the term of this Agreement as indicated below (“Term”) shall commence upon execution of the Agreement and
shall continue as follows:
-- 1-Year Term shall end at the conclusion of the 2027-28 regular season (General Only)
-- 3-Year Term shall end at the conclusion of the 2029-30 regular season (General and Premium)
-- 5-Year Term shall end at the conclusion of the 2031-32 regular season (Premium Only)
-- 7-Year Term shall end at the conclusion of the 2033-34 regular season (Premium Only)
Payment. STH’s who purchase into multi-year agreements will not pay for all seasons up front. Instead, payments for future seasons will need to be paid in full before
the first match each season. ACGR will communicate proper payment schedules for STH’s who select a payment plan option. STH agrees to pay the Full Season
Ticket Price to ACGR on or before the invoiced deadline of each year of this Agreement.
Multi-Year Early Termination. After the first Season of a multi-year membership, STH may terminate the remaining Term by providing written notice to ACGR between
February 1 and July 1 of the applicable year. Because ACGR commits inventory and resources in reliance on multi-year memberships and the actual damages
resulting from an early termination would be difficult to determine at the time of purchase, the STH agrees to pay liquidated damages equal to 25% of the STH’s
annual membership price for each remaining Season in the Term. The parties agree that this amount is a reasonable estimate of ACGR’s anticipated damages
resulting from early termination and is not a penalty. One-year memberships are not eligible for early termination.
INDEMNIFICATION
Each STH agrees to indemnify and hold ACGR, vivenu, and each of their respective parents, subsidiaries, affiliates and licensees, and all of the foregoing's respective
officers, trustees, employees, agents, successors and assigns harmless from and against any third-party claim or demand, including reasonable attorneys' fees,
arising out of STH’s use of the software, the violation of these Terms or an infringement (or the infringement by another user who accesses the software using such
user’s computer equipment or password information) of any intellectual property or other right of any person or entity.
SERVICE MODIFICATIONS
To the fullest extent permitted by law, ACGR may modify, suspend, restrict, or discontinue the ticketing software or any related features at any time, with or without
notice, and shall have no liability arising out of or relating to any such action.
